Kansas School Swapped AI Surveillance Tools to Escape a Lawsuit
Lawrence USD 497 quietly replaced Gaggle with ManagedMethods mid-lawsuit. A federal judge ruled in April 2026 the swap didn't moot the case.
In fall 2025, nine students and former students at Lawrence and Free State High Schools in Kansas had already spent several months suing their school district over an AI surveillance tool called Gaggle. Then, quietly, without a school board vote and without notifying the court, the district stopped using Gaggle and switched to a different platform called ManagedMethods. When the district later asked a federal judge to dismiss the lawsuit because Gaggle was no longer in use, the students’ lawyers made the obvious point: the district hadn’t stopped surveilling students. It had just changed vendors.
Federal Judge Kathryn H. Vratil rejected the dismissal argument. She also, in an April 10, 2026 ruling reported by both the Lawrence Journal-World and the Lawrence Times, found that the district had violated the Kansas Open Records Act by failing to respond properly to records requests from the student plaintiffs. The district’s months-long failure to produce contracts, costs, and internal communications about Gaggle’s implementation prompted a court order. By late April, a follow-up hearing was scheduled on whether the district had acted in good faith.
What Gaggle does, and what the lawsuit alleges
Gaggle is a content moderation and safety monitoring platform sold to K-12 school districts. Once installed, it connects to the district’s Google Workspace accounts and scans every email, every document in Google Drive, and every file shared through the school’s Google ecosystem. The system uses keyword matching to flag content it categorizes as concerning, from messages about self-harm to phrases that might suggest bullying. School administrators or counselors receive notifications about flagged material and can review the underlying communications.
The 74 Million, which has reported in depth on Gaggle, documented that the platform counts more than 1,500 school districts among its clients, covering millions of students. The Christian Science Monitor’s March 2025 investigation into AI safety tools in schools described how the keyword-matching approach operates essentially as a first-pass filter before any human judgment is applied. Because the monitoring covers files as they’re being written, not just messages after they’re sent, it functions as a form of continuous document scanning.
The nine students who filed the lawsuit in August 2025, covered by the Lawrence Times at the time of filing, included current and former student journalists from school publications. Their complaint alleged that Gaggle’s monitoring violated their First and Fourth Amendment rights. The First Amendment claims centered on prior restraint: Gaggle scans emails before delivery, which the students argued amounts to the district intercepting communications before they reach their intended recipients. The Fourth Amendment claims involved unreasonable searches, given that the monitoring covers Drive files and documents being written in real time.
Among the specific harms alleged: Gaggle blocked messages containing phrases like “called me a,” “very uncomfortable,” and references to mental health. The Electronic Frontier Foundation’s 2024 analysis of student surveillance software cited multiple documented cases across districts in which these tools outed LGBTQ+ students to school staff without any intent on the student’s part, intercepted journalism drafts in schools where student journalists were supposed to be exempt, and flagged mental-health messages from students who hadn’t intended to alert anyone. The EFF’s position has been consistent: surveillance tool vendors don’t disclose how their models are trained or evaluated, so districts can’t independently verify what gets flagged and why.

The vendor swap and the court’s response
The district’s switch from Gaggle to ManagedMethods came with no public announcement and no school board vote. The Kansas Reflector reported in October 2025 that the district had ended its Gaggle contract and switched to a different vendor. What those same court documents eventually revealed was that the replacement platform, ManagedMethods, offered the same kind of surveillance of student devices, files, emails, and online accounts as Gaggle. The switch had happened quietly, and the district didn’t disclose it to the court when it argued for dismissal.
In December 2025, the Lawrence Journal-World reported that the district acknowledged the switch in its court filings and responded to the students’ amended complaint, which by that point included the KORA records violations. The amended complaint alleged that the district’s switch to ManagedMethods wasn’t a change in conduct but a rebranding of it. Judge Vratil agreed. She ruled that swapping vendor A for vendor B with identical capabilities didn’t resolve the constitutional questions about whether continuous AI surveillance of student communications is lawful.
On the KORA violations, the ruling was direct. Kansas law requires a public agency to respond to an open records request within three business days. The records the students requested covered contracts, costs, procurement materials, and communications about both Gaggle and ManagedMethods. The district met none of the required deadlines. Judge Vratil’s April ruling, covered in the Kansas Press Association’s reporting the same day, ordered the district to produce the responsive records. The April 23 follow-up hearing addressed whether the six-month delay in complying represented bad faith.
Why this matters beyond one school district
The Lawrence case is specific to one district, but the dynamics it exposes are not. School AI surveillance tools are typically purchased through contracts that are proprietary and not disclosed proactively. The companies keep their model details confidential, meaning districts can’t tell parents what triggers a flag or how accurate the system is. Parents and students frequently don’t know the tools are running at all. When challenged, districts can switch vendors without a public process and without notifying parents that the underlying surveillance is continuing under a different name.
National Law Review’s Privacy Tip coverage of the original lawsuit noted that the case raises constitutional questions that many districts using similar tools have never confronted, because they’ve never been sued. The EFF’s 2024 report made a structural argument: surveillance software vendors promise safety outcomes they can’t independently verify, while the privacy costs, which include routine monitoring of every student’s communications, are borne by students who have no meaningful way to opt out. For student journalists specifically, the First Amendment concern is concrete: a system that reads your drafts before you send them functions as editorial oversight by the school’s vendor.
What these surveillance logs actually contain is worth specifying. Flagged content records include not just the triggering message but the full communications context that the platform reviewed to make the determination. Drive files scanned in real time include unfinished personal essays, draft communications, and anything else a student was writing during their school hours on a district-managed device. These records sit in the vendor’s infrastructure, governed by contracts that students and parents didn’t negotiate and typically can’t review.
FERPA, the Family Educational Rights and Privacy Act, gives students and parents rights over educational records. Whether AI surveillance logs constitute educational records under FERPA has not been definitively settled by the Department of Education. The Lawrence lawsuit may produce guidance on that question, but for the time being, districts and vendors are operating in a space where the rules about retention, access, and deletion of these records are unclear.
What parents and students can actually do
If your child’s school district uses Gaggle, ManagedMethods, Securly, or a similar AI monitoring tool, you have the right to request contracts, usage policies, and data retention agreements under most states’ open records laws. The Lawrence case shows that some districts will resist those requests, but court orders do follow, and the requests themselves create a record that a district can’t easily ignore. The specific KORA request categories that proved productive in the Lawrence case were contracts and costs, procurement materials, vendor communications, and records related to data handling.
The harder problem is that parents usually don’t find out about these tools until after they’re deployed. Asking your district’s technology director whether it uses any content monitoring tools on student devices and Google accounts is a reasonable question, and the answer will tell you whether the issue is live for your child’s school.

What comes next
The constitutional questions at the center of the Lawrence lawsuit, whether continuous AI monitoring of student communications constitutes an unreasonable search and whether pre-delivery email scanning amounts to prior restraint, remain unresolved. The KORA ruling is a significant procedural development, but it’s the First and Fourth Amendment claims that will produce the more consequential legal test. If Judge Vratil’s court reaches a decision on the constitutional merits, it could matter for every district running AI surveillance tools, whether they’re using Gaggle, ManagedMethods, or any of the other platforms competing in this market.
The pattern the Lawrence case has revealed, swap vendors, avoid oversight, fight records requests for months, will likely repeat in other districts facing similar scrutiny. The open records route the Lawrence students pursued is replicable. The legal theory they’re advancing is untested. Both of those facts matter.
